The California Bar Association is seeking the disbarment of John Eastman, a lawyer involved in former President Donald Trump’s efforts to overturn the 2020 election.
George Cardona, the association’s lead attorney, announced the case and its 11 chargein annews release on Thursday. The charges allege that Eastman drafted two memos that suggested strategies to prevent then-President-elect Joe Biden from taking office.
The complaint also accuses Eastman of making false claims about election fraud during a Jan. 6, 2020, rally outside the White House. His remarks “contributed” to provoking a mob of Trump supporters to storm the Capitol and intimidate the then-vice president to prevent the voter count, the state’s bar alleges.
“For California lawyers, upholding the US and California constitutions is the highest legal duty,” Cardona said in a press release Thursday. The Notice of Disciplinary Actions alleges that Mr. Eastman breached that duty by facilitating an attempt to usurp the will of the American people and overturn the results of the nation’s highest office — a blatant and unprecedented attack on our democracy — for which he must be held accountable.”
The complaint notes that a number of officials, including the US Department of Justice, have said there is no evidence of widespread election fraud touted by Trump supporters.
“Eastman knew or should have known that the factual premise for his proposals — that massive fraud had occurred — was false and that Trump had lost his re-election bid,” the association said in a statement.
Eastman will face more legal challenges in the coming months.
He was implicated in a federal criminal investigation allegedly in 2020 election meddling in Atlanta, the news reports. The Committee of the House of Representatives on January 6 also recently asked the Justice Department to investigate Eastman on several criminal charges. During questioning by the committee, Eastman invoked the Fifth Amendment more than 100 times.
Eastman earlier defended his actions in a statement announcing his retirement from Chapman University School of Law, where he taught.
